This Privacy Policy describes how and when I Gemma Fletcher (trading as ‘Little Gem Talents’) collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services.

This Privacy Policy does not apply to the practices of third parties that I work with, and that I do not own or control. These include my canvas and gifts manufacturers, website hosting company, the companies who provide the plug-ins I use on my website, social media platforms, or payment provider. Information I Collect

To fulfil your online order for a canvas, gift item or reiki doll, you must provide me with certain information, such as your name, email address, postal address, and the details of the product that you’re ordering. This is so that I can place your order with the manufacturer (for canvases) and then keep in touch with you regarding its progress. The payments through my website will be processed by PayPal, so your billing information will remain with them.

Payments taken through my website for other services such as distant mediumship, distant angel card readings, distant reiki, and deposits for photo shoots, will also be processed via Paypal.

Invoices for payments will be generated using information captured through PayPal and my online contact form.

Any information you provide me with by using my contact form will be used only for the purposes of responding to you or to fulfil an order, unless you have checked the box to give me consent to send you occasional news and offers.

If you contact me through any of my social media platforms, your details will only be used for the purposes of responding to you.

When visiting me for services it will sometimes be necessary for you to provide me with information on a consent form. This will be used for the purposes of legal compliance only, unless you have expressed consent either on the form or verbally, for me to contact you with occasional news and offers or for feedback.

When browsing my website for the first time and then every 30 days subsequently, you will have the option to accept the use of Cookies. You may also choose to provide me with additional personal information (for a card reading for example), if you contact me directly.

If you choose to use me to fulfil a photoshoot request, I will retain a copy of your images as the copyright holder, but these will not be shared with anyone other than you (for example for advertising purposes on my website or social media pages), without your written consent which can later be withdrawn at any time.

Why I Need Your Information and How I Use It

I rely on several legal bases to collect, use, and share your information, including:

a) as needed to provide my services, such as when I use your information to obtain consent for treatment, fulfil your online order, reply to your enquiries, to settle disputes, or to provide customer support;

b) when you have provided your affirmative consent, which you may revoke at any time, such as by agreeing to receive special offers and information on new services;

c) if necessary, to comply with a legal obligation or court order, or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and

d) as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services.

Information about my customers and respecting their privacy is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

Service providers – For some services, I engage certain trusted third parties to perform functions and provide services to my business, such as assisting me with the making of my products, assisting me with collecting payment, and assisting me with the delivery of goods. I will share your personal information with these third parties, but only to the extent necessary to perform these services.

Compliance with laws – I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention

I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. To comply with the terms of my business insurance policy, I will need to keep your data securely on file for the following time period: 7 years.

Transfers of Personal Information Outside the EU

With the exception of PayPal who are based in the United States, and who I use for collection and processing of payments, as far as I am reasonably aware, none of my customer information is stored and processed outside the EU.

Myself, my third-party manufacturers and my delivery companies are all based inside the European Union.

Your Rights

If you reside in certain territories, including the EU, you have several rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:

Access – You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.

Change, restrict, delete – You may also have rights to change, restrict my use of, or delete your personal information. Aside from exceptional circumstances (like where I am required to store data for legal reasons), I will generally delete your personal information upon request.

Object – You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them through verbal agreement or through expressing your consent on my contact form. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

Complain – If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
